Terms & Conditions

Effective: May 10, 2026 — Sparkle5, LLC

These Terms & Conditions (“Terms”) govern your use of Luvu, a dating platform operated by Sparkle5, LLC, 30 N. Gould Street #10391, Sheridan, WY 82801, USA (“we”, “us” or “Sparkle5”). By registering you accept these Terms in full. If you do not agree, do not use Luvu.

1. Eligibility

You must be at least 18 years old to use Luvu. By registering you declare and warrant that you are 18 or older, that you have the legal capacity to enter into this agreement, and that you have not previously been suspended or permanently banned from Luvu. We may request proof of age at any time. Anyone found to be under 18 will be permanently removed and their data deleted immediately.

2. Account Registration & Security

You agree to provide accurate, current and complete information when registering and to keep it up to date. You are solely responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@sparkle5.com if you suspect unauthorised access. Your account is personal and non-transferable.

3. Dating Service — Special Category Data (GDPR Art. 9)

Luvu is a dating platform. In providing our service we process profile data that may reveal information about your sexual orientation or sexual life (a special category under GDPR Art. 9). By creating a profile and entering your dating preferences you explicitly consent to this processing for the purpose of delivering match suggestions and operating the service. You may withdraw this consent at any time by deleting your account. Withdrawal does not affect the lawfulness of processing before withdrawal.

4. Member Conduct & Prohibited Activities

You agree not to:

  • Post false, misleading or fraudulent information, or impersonate any person.
  • Upload photos of anyone other than yourself, or photos that misrepresent your appearance.
  • Include phone numbers, email addresses, social media handles or external URLs in your profile or opening messages.
  • Post nudity, sexually explicit material, or graphic violence in public profile areas.
  • Send harassing, threatening, abusive, hateful or discriminatory messages.
  • Solicit money, gifts or financial information from other members.
  • Advertise products, services or third-party websites.
  • Send unsolicited bulk messages (spam).
  • Attempt to circumvent our moderation systems, scrape data, or reverse-engineer the service.
  • Use Luvu for any illegal purpose or in violation of any applicable law.

Violations may result in content removal, account suspension or permanent ban, and may be reported to law enforcement.

5. User Content & Licence Grant

You retain ownership of content you upload (“User Content”). By uploading User Content you grant Sparkle5 an irrevocable, perpetual, non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, adapt, publish, translate, distribute, perform and display that content, and to create derivative works, in connection with operating and promoting Luvu. You warrant that you own or have all necessary rights to grant this licence, and that your User Content does not infringe any third-party rights.

6. User Content Warning

Luvu hosts content created by independent members. We do not endorse or verify member-generated content. Other members may post offensive, inaccurate or inappropriate material. Sparkle5 is not liable for other members’ conduct or content. Use the Report button on any profile or message to alert our moderation team. Trust your instincts — if something feels wrong, block and report.

7. Photo Moderation

All photos are reviewed by our automated moderation system and may be reviewed by human moderators before or after publication. We may reject or remove any photo that violates these Terms or our Community Guidelines without notice. Photos taken using the in-app camera on a mobile device receive a “Live” verified badge visible to other members.

8. Subscriptions & Payment

Luvu offers free and premium subscription tiers. Premium subscriptions auto-renew at the end of each billing period unless cancelled before renewal. Prices are displayed in your local currency before purchase. You can manage or cancel your subscription at any time in your account settings. Subscriptions purchased through the Apple App Store or Google Play are governed by the respective store’s payment terms; billing disputes must be directed to Apple or Google.

9. Refund Policy

We will issue a full refund within 72 hours of an initial subscription purchase, provided that no premium features have been used during that period. After 72 hours, or if premium features have been used, refund requests are reviewed on a case-by-case basis at Sparkle5’s sole discretion. Purchased credits are non-refundable once used. Subscriptions purchased via Apple App Store or Google Play are subject to those stores’ refund policies; please contact Apple or Google directly.

10. Indemnification

You agree to defend, indemnify and hold harmless Sparkle5, LLC and its officers, directors, employees, agents and licensors from and against any and all claims, damages, losses, liabilities, costs and expenses (including reasonable attorney’s fees) arising out of or related to: (a) your use of the service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

11. Warranty Disclaimer

Luvu is provided “AS IS” and “AS AVAILABLE” without warranty of any kind. Sparkle5 expressly disclaims all implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free or free of viruses; that defects will be corrected; that other members’ profiles are accurate; or that the service will meet your expectations.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Sparkle5 shall not be liable for any indirect, incidental, consequential, special or punitive damages (including loss of data, loss of profits, or business interruption) arising from your use of or inability to use the service, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the greater of (a) the amount you paid to Sparkle5 in the 12 months preceding the claim, or (b) USD $100. Sparkle5 is not liable for the acts or omissions of other members.

13. Copyright Policy

We respect intellectual property rights. We will suspend or terminate accounts of members who repeatedly infringe third-party copyrights. To report an infringement, send a notice to support@sparkle5.com containing: (1) identification of the copyrighted work; (2) the URL of the infringing content on Luvu; (3) your contact information; (4) a statement of good faith belief that the use is unauthorised; and (5) a declaration that the information is accurate and you are authorised to act. We will act promptly on valid notices.

14. Content Moderation & Appeals

We may remove content or suspend accounts that violate these Terms or our Community Guidelines. Where practicable we will notify you of the action and the reason. You may appeal within 14 days by emailing support@sparkle5.com with the subject line “Moderation Appeal”. We aim to respond within 5 business days. Sparkle5 reserves the right to take immediate action, including permanent banning, for serious violations.

15. Termination

You may delete your account at any time via Profile → Settings → Delete Account. We may suspend or terminate your account at any time for breach of these Terms. On termination your public profile is removed; we retain anonymised data and any data we are legally required to keep in accordance with our Privacy Policy.

16. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Before initiating any formal proceedings you agree to contact us at support@sparkle5.com and attempt to resolve the dispute informally for at least 30 days. If unresolved, any dispute shall be settled by binding arbitration under the rules of the American Arbitration Association, seated in Sheridan, Wyoming. The arbitral award may be entered as a judgment in any competent court.

EU/EEA users: Nothing in this clause limits your rights under applicable EU or EEA consumer protection law, or your right to bring a claim before your local consumer authority or supervisory authority.

17. General Provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Sparkle5 regarding the service. No waiver of any provision shall be deemed a further or continuing waiver.

18. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
